Most injured people have a right to have their health care costs paid and to be fully and fairly compensated for their pain and suffering. Your first source of payment is your own insurance. Closely read your insurance policies. Immediate help may be available through your car insurance Personal Injury Protection (PIP) coverage, Labor and Industries, or medical insurance.

Even if your injuries were not your fault, use your own insurance for immediate, prompt payment. This will not increase your premiums or cause you to be cancelled. It is coverage you paid for. You can pursue the other person's insurance at a later date after you have recuperated.

If your injury was caused by another person, you have a claim against that person for compensation for your injuries, health care costs, lost wages, homemaker assistance, property damage, pain, suffering and other more specialized damages. Your right to compensation will depend upon proving the other person caused your injuries, and how those injuries have damaged you.

Do Not Sign That Release

Do not sign a release until you know your legal rights and are certain of the true extent and duration of your injuries. Talk to your Doctor and Lawyer before signing any document from the insurance company.
